On September 9, a Vinton County judge accepted a mental-evaluation finding that he was incompetent to stand trial. His attorney said his cognitive condition had been declining for years and was considered not restorable.

Her attorney has previously requested competency evaluations, saying he had concerns about whether she fully understood the legal proceedings.
