LINDSAY CLANCY’S LAWYER SPEAKS OUT AS THE JURY REMAINS ᴅᴇᴀᴅLOCKED

PLYMOUTH, Mᴀss. — Lindsay Clancy wouldn’t be able to emotionally handle a second trial if the jury can’t reach a verdict, her lawyer told reporters Tuesday.
“She had a flat affect, she’s sad,” defense attorney Kevin Reddington said about the demeanor of the 36-year-old mother-of-three over the course of deliberations — which are slated to stretch into a fifth day Wednesday.
Reddington said, “No” when asked if Clancy would be able to emotionally handle going through trial again.
The case could potentially end with a hung jury and a retrial after jurors indicated this morning they were ᴅᴇᴀᴅlocked.
Judge William Sullivan told them to continue deliberations — which reached 23 hours before they asked to go home early Tuesday.
Reddington said the decision-making process, which started Thursday afternoon, still “could be a while. As long as they are willing to keep working.”
As for the prospect of a retrial, Reddington said if Plymouth District Attorney Timothy Cruz — who showed up to court Tuesday afternoon — reduced the charges to second-degree murder, it would allow Clancy to opt for a judge rather than a jury if her case underwent a second trial.
“You should ask Mr. Cruz why he did not reduce the charges to second degree so the matter could be waived by a jury and tried by a judge,” Reddington told reporters. “You should ask Mr. Cruz why we are trying on triple homicide first degree, not me.”
Clancy wants the jury to find her not criminally responsible for the murders based on the claim she was experiencing severe postpartum psychosis and hallucinated a voice telling her to strangle her kids and kill herself.
Clancy used elastic exercise bands to strangle Cora, 5, Dawson, 3, and Callan, 8 months, at their Duxbury home on Jan. 24, 2023.
Immediately after, she made a suicide attempt by cutting her wrists and neck, downing prescription meds and throwing herself out of the window of her second-floor bedroom.
Prosecutors alleged Clancy carefully planned the killings because she wanted to take her own life and take the kids with her.
Reddington blamed the tragedy on Clancy’s negligent health and mental health care by providers who allegedly misdiagnosed and overmedicated her in the four months before the crimes when she was battling debilitating insomnia, anxiety, depression and intrusive thoughts about suicide and harming the children.
The jury is due back Wednesday morning for the fifth day of deliberations.
