New details from the affidavit in the Kailey Erhart case in Mandan, North Dakota describe a terrifying confrontation inside the family home on August 6, 2026.

According to investigators, Erhart’s husband was at home with the children when the situation escalated. The affidavit says he managed to take a firearm away from Erhart during a struggle and disᴀssemble it before he and the children’s grandmother were forced outside.

Investigators also say video recovered from the father’s phone captured part of the confrontation, including Erhart carrying one child while holding the firearm. The affidavit says she then made a frightening statement to the children’s father.

Police later found three children seriously injured inside the home. Two, aged five months and three years, did not survive, while their one-year-old sibling underwent surgery and has since been reported to be expected to make a full physical recovery.

Erhart, 22, faces multiple charges, including two counts of murder and one count of attempted murder. The allegations remain matters for the court to determine.

The affidavit has brought renewed attention to the father’s attempt to intervene before the situation became even more devastating—and to the warning signs reportedly documented before that night.
