Months after 13-month-old Preston Elijah Davey lost his life, the evidence presented during the criminal trial painted a devastating picture of prolonged abuse, repeated warning signs, and a safeguarding system now facing intense public scrutiny. Investigators say one of the most significant turning points was not a witness statement or a confession—but videos recovered from a mobile phone that contradicted the explanations repeatedly given to professionals.

According to evidence presented during the trial, Preston was born on June 16, 2022, and entered emergency foster care just days after birth. For much of his first year, professionals described him as a healthy and thriving child.

One recording reportedly shown as an explanation for bruising was later determined to have been filmed nearly two weeks before the injury it was supposedly documenting.

Prosecutors argued that this evidence demonstrated deliberate attempts to mislead professionals investigating Preston’s condition.

Perhaps the most emotionally difficult evidence presented during the trial involved recordings made only days before Preston’s death.

Police told the court that one video showed Preston left alone in a bathtub for more than 14 minutes while visibly distressed.

During sentencing at Preston Crown Court, the judge described the crimes as being of the “most extreme gravity.”

Varley received a whole-life order, meaning he will never be eligible for parole, while McGowan-Fazakerley was sentenced to 25 years in prison.

Yet even after the verdicts, public attention has increasingly shifted beyond the courtroom.

Many observers have focused on the broader safeguarding questions highlighted throughout the proceedings.

Court evidence showed Preston had been seen by healthcare professionals on multiple occasions.

Police had been contacted.

Safeguarding agencies had become involved.

Despite these interactions, he remained in the same environment until his death.

England’s Children’s Commissioner later described the case as a profound failure of the safeguarding system and called for a thorough examination of whether opportunities to protect Preston had been missed.
