A mother has been sentenced to 35 years in prison for the death of her five-year-old son, AJ Freund, in a case that deeply affected communities across the United States and renewed concerns about child welfare systems.

JoAnn Cunningham, 37, pleaded guilty to the murder of her son, who died in April 2019 after enduring prolonged abuse. Although she faced a possible maximum sentence of 60 years, the court ultimately sentenced her to 35 years in prison.

AJ’s disappearance initially triggered a six-day search before investigators discovered his body buried in a shallow grave near Woodstock, Illinois. The heartbreaking discovery shocked the public and brought national attention to failures within child protection services.

Court records revealed that AJ had been subjected to severe physical and emotional abuse before his death. Authorities later confirmed that his mother was responsible.

The case also highlighted longstanding concerns about Cunningham’s history. She had previously struggled with substance abuse, mental health challenges, and neglectful behavior that had been known to authorities for years.

The Illinois Department of Children and Family Services (DCFS) had investigated multiple reports involving Cunningham before AJ’s death. Despite repeated warnings and concerns raised by various individuals, AJ remained in her care.

During the investigation, AJ’s father, Drew Freund, told authorities that Cunningham had forced AJ into a cold shower while demanding that he confess to hiding soiled underwear. He described how the situation escalated into violence and how she used a detachable shower head on the child’s face.

According to testimony, AJ repeatedly lost his balance and fell during the ordeal.

In the early hours of April 15, 2019, Cunningham woke Freund and told him that AJ was no longer breathing. The couple searched online for information about child CPR, but AJ had already died.

Freund later placed AJ’s body inside a plastic container in the basement, where it remained for several days before being buried in a wooded area.

While authorities and volunteers searched for the missing child, Cunningham publicly pleaded for help finding her son, despite already knowing what had happened.

She later became a central suspect in the investigation.

Drew Freund was also charged with first-degree murder in connection with AJ’s death. He pleaded not guilty and awaited trial.

During sentencing, Judge Robert Wilbrandt described Cunningham’s actions as “inhumane, repulsive, and frankly, shocking.” He said she had spent years “lying, cheating, and manipulating” while terrorizing her young son.

A forensic pathologist testified that AJ suffered fatal head injuries, along with bruises and cuts across his body. His official cause of death was determined to be the inhalation of his own blood.

Investigators also documented circular marks on AJ’s forehead that were consistent with a detachable shower head.

Subsequent reviews revealed that DCFS had received numerous reports regarding Cunningham’s treatment of children, including concerns raised before AJ was even born. Over the years, reports had come from police officers, medical staff, neighbors, and members of her own family.

Judge Wilbrandt emphasized that Cunningham had been entrusted with AJ’s life and must now be held responsible for his death. He acknowledged that no sentence could undo the harm that had been done but said the court had a duty to deliver justice.

AJ’s family expressed disappointment that Cunningham did not receive the maximum sentence, but they also acknowledged that no punishment could ever ease their grief.

In a statement, they said:

“AJ was an innocent, precious little boy whose life was taken from him after enduring unimaginable pain and suffering.”

During the hearing, Cunningham spoke about her own history of feeling abandoned, unloved, and rejected. She said she had experienced years of emotional and physical abuse and admitted to using drugs to cope with anxiety, depression, and personal struggles.

However, she stopped short of offering a full apology for AJ’s death.

AJ’s story has become a powerful reminder of the importance of protecting vulnerable children and strengthening child welfare systems.

The case sparked widespread calls for reform, with many questioning how repeated warning signs failed to prevent such a tragedy.

Although nothing can bring AJ back, his family continues to advocate for stronger protections for children and greater accountability within child welfare agencies.
