The lawsuit alleges that a daycare employee lifted the toddler, identified in court documents as “C.K.,” several feet into the air during a playful interaction before being unable to catch him, resulting in the child falling and striking his head.

The family states that the employee attempted to comfort the child immediately after the incident as he cried. Other adults present reportedly witnessed the event.

Court filings indicate that C.K.’s father had dropped him off earlier that morning before going to a nearby facility. According to the lawsuit, daycare staff initially contacted the family to report that the child had fallen but indicated that he appeared to be calming down. A short time later, employees called again, asking that he be picked up because they were unable to comfort him.

When his father arrived, the lawsuit alleges he observed significant bruising and swelling on the toddler’s face. After returning home, the child reportedly became increasingly drowsy and lethargic, prompting his family to seek immediate medical evaluation.

According to the complaint, physicians later diagnosed C.K. with a traumatic brain injury related to blunt head trauma. The family further alleges that he continues to experience lasting effects, including hearing loss.

The lawsuit also claims that information initially provided about the incident differed from what the family later observed after reviewing surveillance footage. These allegations have become a central part of the legal action.

In addition to negligence claims, the complaint includes allegations of battery, fraud, and intentional infliction of emotional distress. It also raises questions regarding the facility’s licensing status and its claimed exemption under California childcare regulations.

The Bay Club had not publicly responded to the allegations at the time the lawsuit was reported. Because the matter is currently before the courts, the claims contained in the complaint have not been proven, and the legal process will determine the facts of the case.
