Wade Wilson’s Legal Battle Could Reach Washington — Florida Appeal Remains OPEN as His Defense Weighs Its Next Move ⚖️🚨

Wade Wilson’s legal fight is continuing in Florida, but a consтιтutional issue raised by his defense could potentially become part of a future appeal to the U.S. Supreme Court.

Wilson was sentenced to de@th twice in August 2024 for the 2019 killings of Kristine Melton and Diane Ruiz in Cape Coral, Florida. His direct appeal challenges his convictions and sentences on seven grounds, including arguments concerning Florida’s revised capital-sentencing law.

At the center of the dispute is whether the state could apply its 2023 law allowing a jury to recommend a de@th sentence when at least eight of its 12 members agree. Wilson’s defense has argued that the law should not apply to his case.

During oral arguments on February 5, 2026, attorney Michael Ufferman acknowledged that the Florida Supreme Court had recently addressed the central legal issues raised in his brief. The arguments were consequently brief, but the hearing remains an important part of the appeal’s record.

The possibility of further review in the U.S. Supreme Court is a separate matter. Preserving a consтιтutional argument does not mean that a peтιтion will necessarily be filed, accepted, or decided in Wilson’s favor. The nation’s highest court independently chooses which cases it will hear.

Meanwhile, Florida’s official appellate docket lists SC2024-1345 as OPEN. That confirms the direct appeal remains active in the court system; it does not, by itself, indicate how the justices will rule.

For now, Wilson’s immediate legal battle remains in Florida. Whether the dispute eventually reaches Washington will depend on subsequent court proceedings and any future peтιтion for review.
