Lindsay Clancy Faces Three Major Legal Challenges as Retrial Questions Remain Unresolved

Lindsay Clancy’s case remains in a complicated legal stage following the September 4 mistrial, with her defense pursuing several motions that could affect whether prosecutors are able to bring the case to trial again.
One major motion argues that a retrial would violate Clancy’s consтιтutional protection against double jeopardy. Her attorneys contend that the mistrial should not have been declared without a more thorough examination of the disputed holdout juror.
The defense has also asked the judge for a required finding of not guilty, arguing that prosecutors did not present sufficient evidence to support the charges. On October 1, however, the judge rejected that request, ruling that a reasonable jury could find Clancy guilty based on the evidence presented at trial.
