Stephen Schneider reportedly told investigators he had consumed two Guinness beers and a Miller Lite during dinner before the July 19 Barnegat Bay crash.

According to the probable-cause affidavit, a court-ordered blood sample obtained at 12:46 a.m. later showed a 0.16% BAC, twice New Jersey’s 0.08% legal limit. The testing was conducted hours after the crash, which occurred at about 9 p.m

The affidavit says doctors who reviewed the laboratory results concluded that Schneider was unfit to operate a motor vehicle and that alcohol had markedly affected his alertness, judgment, coordination and response time.

The discrepancy between Schneider’s reported alcohol consumption and the later BAC result has become a significant part of the prosecution’s case. Schneider faces two counts of reckless vessel homicide and has pleaded not guilty.
