⚖️💔 MACKENZIE SHIRILLA FACES ANOTHER LEGAL SETBACK — OHIO SUPREME COURT DENIES HER LATEST APPEAL BID 🕊️

Mackenzie Shirilla has suffered another setback in her ongoing legal battle.

The Ohio Supreme Court has denied her attorneys’ request to reconsider the court’s earlier decision not to hear her latest post-conviction appeal, leaving the lower court’s ruling in place.

Shirilla was convicted in 2023 in connection with the July 2022 crash that killed her boyfriend, Dominic Russo, 20, and their friend, Davion Flanagan, 19.

Prosecutors argued that Shirilla intentionally drove her car into a building at nearly 100 mph, while her defense has maintained that the crash was not intentional.

After a bench trial, Shirilla was found guilty of multiple charges, including murder, felonious ᴀssault, and aggravated vehicular homicide. Her convictions were later upheld on direct appeal.

Her latest legal challenge centered in part on claims that her attorneys had failed to adequately investigate a possible medical condition known as Postural Orthostatic Tachycardia Syndrome, or POTS.

Her lawyers argued that the condition could potentially have caused her to lose consciousness before the crash, which they say could help explain why she did not brake.

But the latest rulings did not decide whether that medical argument was correct.

Instead, the courts focused on a procedural issue: whether Shirilla’s post-conviction peтιтion had been filed on time.

The relevant ᴅᴇᴀᴅline was determined to be October 23, 2024.

Shirilla’s peтιтion was filed one day later, on October 24.

Her attorneys argued that the timing was affected by confusion surrounding the 2024 leap year and the calculation of the ᴅᴇᴀᴅline. The courts rejected that argument and determined that the filing was untimely.

In June 2026, the Ohio Supreme Court declined to accept the case.

Her attorneys then asked the court to reconsider.

That request has now been denied as well.

The decision marks another major obstacle for Shirilla at the state level.

She is currently serving a 15-years-to-life sentence at the Ohio Reformatory for Women. Her case has also received renewed public attention following the release of the Netflix documentary The Crash.

However, her legal fight may not be completely over.

According to recent reporting, her attorneys have also pursued a separate federal challenge alleging consтιтutional violations. That case is distinct from the state appeals that have now been rejected.

For the families of Dominic Russo and Davion Flanagan, however, no legal ruling can undo what happened on that July night.

Two young lives were lost.

Two families were changed forever.

And years later, the case continues to raise difficult questions about intent, medical evidence, criminal responsibility, and the limits of the appeals process.
