THE MOST EMOTIONAL TRIAL OF MY CAREER — LINDSAY CLANCY’S LAWYER MAKES A STUNNING ADMISSION AS JURY REMAINS DE-ADLOCKED, THEN REVEALS WHAT HE PLANS TO DO AFTER THE VERDICT — AND WHY A SECOND TRIAL COULD BE “UNBEARABLE”
LINDSAY Clancy’s high-profile lawyer has declared her trial the most emotional one he’s worked in his decades-long career.
Defense attorney Kevin Reddington also joked he’s sleep deprived following six weeks of Lindsay’s grueling trial when speaking with The U.S. Sun outside of the Plymouth County Superior Court.
Court on Monday wrapped around 4pm with jurors still without a verdict in the trial where Lindsay faces three murder charges for strangling her children to death in January 2023.
Reddington argued his client was not criminally responsible for murder because she was suffering from undiagnosed postpartum depression at the time of the killings and could not differentiate right from wrong.
When asked by The U.S. Sun if Lindsay’s trial was the most difficult trial he’s worked in his over 50 years as a defense attorney, he said it’s the “Most emotional case I’ve done probably, but I mean there’s been a few tough [ones].”
As for his plans for after a verdict comes out, Reddington won’t be stepping away from courtrooms.
“Actually, I have another case on the western part of the state,” he said as he was flanked by several microphones and cameras.
A throng of reporters, TV crews and content creators have surrounded the attorney in recent weeks as he appears to welcome the attention that has turned him into an unlikely local celebrity.
Lindsay makes a more controlled entrance, arriving in a Plymouth County Sheriff’s vehicle before being brought inside under the supervision of deputies.
While he won’t be taking vacation any time soon, the 75-year-old with a black belt in karate is sure to make time to get away with his demanding schedule.
“We usually try to go away like in January, to the Caribbean or something, you know.”
Jurors have been deliberating for 18 hours as of 11am on Tuesday as they weigh five options for Lindsay’s fate.
The Mᴀssachusetts mom could be acquitted or found not guilty by lack of criminal responsibility, or could be convicted of first-degree murder, second-degree murder or manslaughter.
Reddington – who arrives to court each morning around 8:30am in his green Ford Bronco – said all they could do was “just get through the day” as jurors were “working hard” reviewing 300 exhibits in the case.
Just after 10am on Tuesday, Judge William Sullivan announced the 12 jurors could not come to a unanimous decision, sending them back to continue deliberations.
Reddington has not speculated on what kind of outcome the trial will have or how long it will take for jurors to reach a decision.
“It’s entirely up to a jury, it doesn’t matter. There’s no limit, the judge can’t pull the plug. I’ve had juries out a max of ten days,” he told The U.S. Sun.
Reddington said Lindsay has been “nervous” throughout the trial, and while jurors spend days deliberating, he spends time reᴀssuring his client.
“I try to keep her spirits up, I talk to her and distract her, you know. It’s tough.”
Reddington, who has an extensive tattoo collection beneath his suits and is rarely seen without coffee, also revealed Lindsay has received about three banker boxes full of letters of support.
“She reads every letter,” he told The U.S. Sun.
“It’s given her support, that she knows there are people out there that have not judged her and know that she is a wonderful, wonderful person.”
Reddington said he does not read the letters and is not sure if the former labor and delivery nurse would respond to any of them.
“I haven’t really asked her about it, that’s her private review of the letters,” he explained.
Hundreds of people gathered outside the Plymouth courthouse on August 21 in a silent rally showing their support for Lindsay.
“I’ve tried to tell her that there’s a lot of people that are behind her and at least recognize the fact that she’s a nice person and was dealt bad by the medical profession,” Reddington previously told The U.S. Sun.
When asked about how his client was coping with the trial, he said, “She doesn’t have a mindset, you know, she just listens and sits there.”
He added that Lindsay is “doing okay” as she undergoes treatment at Tewksbury Hospital, where she has been held for most of the last three years.
Lindsay remains largely expressionless and is rarely seen smiling, even when Reddington briefly chuckles beside her. At times, she leans toward her lawyer and speaks to him in hushed tones.
Lindsay’s trial brought five weeks of testimony from her then-husband Patrick Clancy, family members, first responders who responded to her Duxbury home, her medical providers and those who met with her after the killings.
The testimonies delved into what unfolded on January 24, 2023, when Lindsay strangled her children, five-year-old Cora, three-year-old Dawson and eight-month-old Callan while Patrick was briefly out of the house.
Patrick returned home from running errands to find Lindsay on the ground in the backyard following her attempt to end her life after strangling her children.
The prosecution argued Lindsay acted deliberately when killing her children and showed evidence of planning by sending Patrick out of the house.
Ultimately the jury will decide whether to convict the 36-year-old and if she will face time in prison or be committed to a state psychiatric facility for treatment.
What is a hung jury?
Lindsay Clancy’s murder trial has divided America as she argues she lacked criminal responsibility for killing her three children in January 2023. As the jury continues to deliberate, it raises the possibility that there could be no unanimous decision, resulting in a hung jury.
If there is a hung jury, the case could result in a mistrial.
But Judge William Sullivan has a few options he can take before declaring a mistrial.
He can instruct them to continue deliberating, even more than once.
Jurors are urged to continue looking through evidence when they are sent back for deliberations.
And if after multiple requests the jury is still not unanimous, he could give jurors an Allen charge, also known as the dynamite charge, because it can often blow up a ᴅᴇᴀᴅlocked jury by reminding them to be open to changing their minds.
If the jury still comes back ᴅᴇᴀᴅlocked, Sullivan would likely declare a mistrial.
In the event of a mistrial, Clancy would not be convicted or acquitted, but could be tried again in the future.
In that case, the process would start back over again with the selection of a new jury.
