The tragic case of 13-month-old Preston Davey has become one of the most heartbreaking child protection cases in recent UK history, raising profound questions about safeguarding, accountability, and whether more could have been done to protect a child who had already entered the care system.

Born in June 2022, Preston—also known as Elijah—was placed into emergency foster care just days after birth. For the first several months of his life, those caring for him described him as a healthy, happy, and smiling baby. Professionals believed he was beginning a safer chapter, and in March 2023, an adoption panel approved his placement with Jamie Varley and John McGowan-Fazakerley.

On 27 July 2023, Preston was taken to Blackpool Victoria Hospital after suffering a medical emergency. Despite the efforts of healthcare professionals, he could not be saved. A Home Office post-mortem determined that the cause of death was acute upper airway obstruction. These findings formed a central part of the prosecution’s case during the trial.

Following proceedings at Preston Crown Court, Jamie Varley was convicted of multiple offences, including the murder of Preston, child cruelty, Sєxual offences, and offences involving indecent images connected to the child. The court imposed a whole-life order, the most severe sentence available under the law in England and Wales, meaning he will spend the remainder of his life in prison.

John McGowan-Fazakerley was convicted of causing or allowing the death of a child, child cruelty, and Sєxual ᴀssault. He was sentenced to 25 years’ imprisonment, subject to the applicable legal provisions governing parole eligibility.

The verdicts brought a measure of justice through the criminal courts, but they also prompted wider questions extending far beyond the two defendants.
