Preston Davey Case: Court Hears New Forensic Evidence as Trial Continues

The case surrounding the death of 13-month-old Preston Davey has continued to draw significant public attention as new forensic evidence presented in court raises serious questions about the circumstances leading to his death.
Preston, a toddler from Blackpool, England, had been placed in the care of Jamie Varley, 37, and his partner John McGowan-Fazakerley, 32, who were in the process of adopting him. Four months after being placed with the couple, Preston died on July 27, 2023.
According to court proceedings at Preston Crown Court, the two men initially told medical staff that Preston had drowned after being left unattended in a bathtub for a few minutes. They rushed him to Blackpool Victoria Hospital, where doctors attempted to resuscitate him for nearly an hour before he was pronounced ᴅᴇᴀᴅ at approximately 7:20 p.m.

However, forensic evidence presented during the trial has challenged that account.
Forensic Evidence Presented in Court
Home Office forensic pathologist Dr. Alison Armour testified that her post-mortem examination found no evidence consistent with drowning. She stated that there was no water in Preston’s lungs or stomach, findings that would commonly be expected in drowning cases.
Instead, the official cause of death was identified as acute upper airway obstruction, indicating that Preston’s airway had been blocked.
The court also heard evidence of numerous injuries, including bruising to various parts of his body, internal injuries to the throat, and a fracture to his upper left arm. Experts testified that these injuries were not consistent with accidental causes or with medical resuscitation efforts carried out at the hospital.
Dr. Armour said she ruled out natural illnesses, infections, and genetic conditions.
Allegations of Ongoing Abuse
Prosecutors allege that Preston was subjected to repeated physical abuse during the months he lived with the couple.
Evidence presented to the jury included previous hospital visits and videos recovered from a mobile phone. Prosecutors allege that some recordings showed Preston in unsafe situations, including being left unattended in a bath for an extended period.
Additional allegations of Sєxual abuse were also presented during the trial.
Jamie Varley denies murder and all abuse-related charges. John McGowan-Fazakerley denies charges connected to allowing Preston’s death and other related offences. Both men maintain their innocence.
Questions About Child Protection Systems
The case has also prompted wider discussions about adoption and safeguarding systems.
Preston had previously been in foster care before being placed with the couple in April 2023. His death just four months later has led many to question whether warning signs were missed and whether existing safeguarding measures were sufficient.
Authorities and agencies involved in his care may face further scrutiny once legal proceedings conclude.
A Community Seeking Answers
Those who knew Preston have described him as a happy and affectionate child. Foster carers referred to him as a “really lovely baby,” making the details presented in court especially difficult for many people to process.
As the trial continues, jurors will examine extensive medical, forensic, and digital evidence before reaching a verdict.
The case remains a reminder of the importance of protecting vulnerable children and ensuring that safeguarding systems are able to identify and respond to signs of potential harm as early as possible.
