An 18-month-old boy’s tragic death has left a New York community heartbroken while prosecutors pursue criminal charges against his mother over the circumstances surrounding the incident.

Luke Russell Jr. died after a choking emergency inside an Airbnb rental in Merrick, Long Island, on April 12. According to Nᴀssau County prosecutors, Luke and his 3-year-old sister were staying with their mother, 36-year-old Olivia Bithorn, when the tragedy occurred.

Prosecutors allege that Bithorn became heavily intoxicated while caring for the children and left them unattended for a period of time. They further allege that Luke was given uncooked popcorn kernels, which caused him to choke and obstructed his airway. Authorities contend that emergency responders were called only after the child had been unresponsive for an extended period.

When first responders arrived, they attempted lifesaving measures, but Luke was pronounced ᴅᴇᴀᴅ.

During court proceedings, Nᴀssau County District Attorney Anne Donnelly argued that the circumstances went beyond a tragic accident, alleging that the child’s death resulted from criminal neglect. Investigators also cited evidence collected from the rental property, including pH๏τographs and witness statements gathered during the months-long investigation.

However, court records indicate that Bithorn disputes key allegations. According to prosecutors, she told investigators she would not have intentionally given uncooked popcorn to her son and suggested the kernels may have ended up on the floor after she prepared a snack for Luke’s older sister. The criminal case remains ongoing, and the allegations have not been proven in court.

The heartbreaking incident has sparked renewed conversations about child safety, supervision, and choking hazards involving young children. Medical experts have long warned that foods such as popcorn can pose a serious choking risk for toddlers because of their small airways and limited ability to chew effectively.
